On Thursday, the Federal High Court in Abuja struck out a suit seeking the disqualification of Governor Gboyega Oyetola of Osun state as the governorship candidate of the All-Progressives Congress (APC), in Saturday’s election.
This ruling was sequel to the lawsuit instituted by APC governorship aspirant, Moshood Adeoti.
Adeoti is from the faction of Minister of Interior, Rauf Aregbesola. Shortly after Oyetola was declared the winner of the primary, Adeoti headed for the Federal High Court in Abuja, where he challenged the governor’s eligibility to contest the primary, while still serving as a member of the National Caretaker Committee of the party.
However, the presiding judge, Justice Inyang Ekwo, in his ruling stated that the plaintiff, Adeoti failed to support the process with relevant laws, and as such, showed no cause of action in the suit which makes it a gross abuse of court process.
Justice Inyang added that the suit instituted falls outside the scope of section 87(9) of the Electoral Act and Section 22 of the 1999 Constitution as amended.
