Okowa Wins Governorship Election In Delta

The Independent National Electoral Commission (INEC) on Monday declared Sen. Ifeanyi Okowa, the candidate of Peoples Democratic Party (PDP), winner of Saturday governorship election in Delta. The Returning Officer for the election, Prof. Bio Nyananyo, announced in Asaba that Okowa polled 724,680 votes to beat his closest rival, Chief Great Ogboru of the Labour Party, who got 130,028 votes.

Chief O’tega Emerhor of All Progressives Congress (APC) finished in the 3rd position with 67,825 votes. Nyananyo said that Okowa won in 21 local government areas out of the 25 in the state while Ogboru clinched the remaining four LGAs.

“Okowa, having won the highest votes in the elections, which was contested and having satisfied the provisions of the law is hereby returned as winner and governorship-elect for Delta”, he declared.

He announced that 18 political parties participated in the governorship election while there were 2, 044,372 registered voters and 1,017,796 accredited voters. He said the exercise recorded 931,808 valid votes while 24,913 ballots were rejected.

Results in Nigeria’s governorship vote saw a swing towards president-elect Muhammadu Buhari’s All Progressives Congress (APC) party on Monday, two weeks after it made history by unseating the incumbent in a presidential poll.

Eight states have so far abandoned the People’s Democratic Party’s (PDP) of defeated president Goodluck Jonathan in favour of the APC — which now has a total of 20 states, more than half of the territories up for grabs against the PDP’s 13.

The results completed an unprecedented shift in Nigerian politics, away from the PDP which has dominated since the end of military rule in 1999. Nigeria’s 36 state governors are among the most powerful politicians in the country, controlling budgets bigger than those of many African countries and wielding influence that can decide which candidates go on presidential tickets.

Jonathan’s supporters took some heart by holding onto the strategically vital southern oil hub of Rivers state, in a landslide victory announced on Monday.

The governorship polls were held in just 29 states on Saturday, since seven had already been settled in by-elections over the past few years.

President-elect Muhammadu Buhari, who won a decisive victory in the March 28 presidential poll and a majority in both legislative houses, takes power on May 29.

As in past governorship polls, these ones were marred by violence, intimidation and reports of fraud. Observers said they were dirtier than the presidential ones, particularly in the oil-producing delta region’s Akwa Ibom and Rivers states — but better technology meant there was less outright fraud than in past gubernatorial polls. At least ten people were killed in violence across the country.

The U.S. embassy congratulated Nigeria for an electoral process that it said “generally went well across the country.”

“We have seen the reports of violence and alleged irregularities … and call on those dissatisfied to pursue their grievances peacefully in the judicial arena,” it added.

Around 100 people gathered in the capital of Abia state, in the Niger Delta, to protest against alleged fraud on Monday.

One state remained with the minor opposition All Progressives Grand Alliance party, while one was deemed inconclusive and one had yet to be announced by the electoral commission by Monday by 12.30 p.m. (1130 GMT).

 

Go To Tribunal, INEC Tells Aggrieved Politicians

The Independent National Electoral Commission, INEC has asked aggrieved politicians to take their grievances to the election petition tribunals.

The commission said that though some pockets of violent incidents were recorded during Saturday’s governorship and State Houses of Assembly elections, it still maintained that the exercise recorded a pass mark.The electoral body stated this in a statement issued in Abuja on Sunday.election

It said that INEC’s records showed that there were 66 reports of violent incidents targeted at polling units, the commission’s officials, voters and election materials.

The elections were held in 29 states, while the state Houses of Assembly elections were held in 36 states.

No election took place in the Federal Capital Territory, Abuja.

It said its general assessment showed that the elections went well across the country.

The commission said that preliminary reports it got showed that 88.9 per cent of polling units opened for accreditation between 8am and 10am across the country and that only 5.2 per cent had yet to open as of 1 pm.

Also, it claimed that 73 per cent of the polling units had commenced voting by 2.30 pm.

The commission said, “The process of accreditation with Smart Card Readers was also successful in a majority of the polling units.

“Initial challenges were recorded in Edo and Abia states, but the technical teams deployed to support the states were able to resolve the issues in a timely manner.”

Overall, it said that many parts of the country remained relatively peaceful during the elections, but claimed that some states, however, recorded a significant number of violent incidents.

It listed states that were mostly affected as Rivers, Akwa Ibom, Cross River, Ebonyi and Ondo states.

The electoral body said, “INEC’s records show that there were 66 reports of violent incidents targeted at polling units, the commission’s officials, voters and election materials.

“These were in Rivers State (16 incidents), Ondo (eight), Cross River and Ebonyi (six each), Akwa Ibom (five) Bayelsa (four), Lagos and Kaduna (three each), Jigawa, Enugu, Ekiti and Osun (two each), Katsina, Plateau, Kogi, Abia, Imo, Kano and Ogun (one each).

“The commission is investigating these incidents and will do everything within its powers to bring the culprits to justice.”

INEC commended Nigerians for once again demonstrating their resolve and commitment to participate in the electoral process and by doing so, contributing to deepening democracy in our country.

The commission called on every citizen to maintain the peace “as the results of the governorship and state Houses of Assembly elections are being processed, and to accept the official outcomes.

“It would like to emphasize that winners can only emerge after collation of the official results and on the basis of the requirements prescribed by the legal framework.

“Any aggrieved persons or groups are encouraged to seek redress at the tribunals.”

INEC reminded all stakeholders that the process was not yet completed and urged restraint in their comments, as it strived to bring the process to an orderly, peaceful and credible conclusion.

Genuine Democracy? Nigeria Has Chance To Rewrite Script

The victory of opposition candidate Muhammadu Buhari in Nigeria’s presidential election could mark a turning point towards genuine democracy for the country, improving the image and moral standing of Africa’s troubled giant.

The defeat of President Goodluck Jonathan, whose People’s Democratic Party (PDP) has run Africa’s most populous nation since it returned to civilian rule in 1999, was the first time a Nigerian head of state lost power to an opposition challenger through the ballot box.

“It’s not the result that we wanted but it’s a good day for Nigeria if we show the world we can run a credible election,” said a minister in Jonathan’s government, who did not wish to be named because others in the PDP were angry about the result.

Jonathan telephoned Buhari on Tuesday to congratulate him on winning this weekend’s election, a spokesman for Buhari’s All Progressives Congress (APC) said.

Now Africa’s biggest economy, Nigeria has nevertheless been held back by the legacy of three decades of army misrule: a mix of corruption, weak institutions, political, ethnic and religious violence, and a dearth of infrastructure.

Nigeria accounts for about one in six Africans and a fifth of African GDP, giving it huge potential influence on the continent and beyond, but instead for decades it has been a by-word for corruption and chaos.

It ranks 136th out of 174 on Transparency International’s index of perceived corruption, a problem that affects Nigerian society from top to bottom and cannot be turned around overnight, even by the austere Buhari.

Nevertheless, a transfer of power from one political party to another, achieved through voting rather than violence, is a marked improvement on previous elections since 1999 which were widely believed to have been rigged in favour of the PDP.

“It will help reinforce perceptions across the continent that the old ways are much harder to get away with,” said Antony Goldman, a business consultant with high-level contacts in Nigeria. He highlighted the role of voters armed with mobile phones and Internet connections in preventing vote-rigging.

While the challenge in turning Nigeria around is as daunting as ever, it would be a positive outcome if the ruling class no longer felt it could stay in power regardless of performance, analysts said.

“THEY HAVE TO DELIVER”

“Especially in Nigeria, given the history, the bad name it has, I think this will be a positive surprise,” said Antoon de Klerk, a portfolio manager at Investec Asset Management who invests in African bonds and currencies.

“There’s a greater degree of accountability. The fact that they can lose means they have to deliver.”

Therein lies the challenge for Buhari, whose democratic credentials have yet to be fully tested. He first wrote his name in Nigerian history when, as a general, he ousted a civilian government in a 1983 coup. He was deposed two years later by another general.

Now, he faces a new set of problems, not least the Boko Haram Islamist insurgency in the North and the risk of unrest flaring up in the oil-producing Niger Delta when Jonathan, a son of the Delta, is no longer in power.

“There is a great deal of disaffection with the narrowness of the leadership choices and a worry over the military past and credentials of candidates,” said Christopher Cramer, a professor at the School of Oriental and African Studies in London.

“Nigeria will only really garner greater international authority if it can show a much more effective political and security strategy for dealing with the multiple challenges the country faces, from Boko Haram in the North to the ongoing corruption, criminality, and conflict in the Niger Delta.”

There is also the issue of Nigeria’s finances, which have been badly hurt by a dramatic fall in global oil prices.

“If you’re running an unsustainable set of macro-economic policies sooner or later, unless that changes, you’re going to get into trouble,” said Jan Dehn, head of research at Ashmore Group, an emerging markets investment manager.

“Nigeria has not concluded its adjustment to the fall in oil prices. The fact that the election now looks to be drawing to a close is very good because this will now free the government to be able to undertake that much-needed adjustment,” he said.

Consultant Goldman said that even in opposition, the PDP had a role to play in turning Nigeria into a genuine democracy.

“To have a democracy you need not only to have credible elections and a choice,” he said. “The PDP has enjoyed the trappings of power for 15 years. The challenge for it now is to prove itself to be effective in opposition.”

“I have found it hard to pay the wage bills owing to the declining federal allocation to the state.

Aregbesola said the situation became so bad at a time that he resorted to the state’s reserves and exhausted it on payment of salaries.

The governor added that the government went ahead to accumulate debt of N12 billion in its bid to ensure that salaries were paid.

He said that he would not mind to borrow more “just to ensure that workers were paid but the “banks would not grant more loans.”

He said: “Osun is next to Lagos in the sheer size of its civil service.

“In fact, the state inherited 50 per cent of all the workers in the old western state and more than 75 per cent in the old Oyo State.

“I was meeting my wage bill of over N3.6 billion with N4.6 billion federal allocation until July, 2013 when the Federal Government announced a decline of about 40 per cent allocation to states.

“This reduced the state’s allocation from N4.6 billion with which I was meeting my bills to N2.6 billion.

“Since then, Osun has had to augment salaries by sometimes N1 billion, sometimes N1.6 billion.

“Before the last time I paid salaries in November, 2014, I have had to either spent the state’s reserves on salaries or borrow money.

“Today, I have a loan of N12 billion that we spent on salaries and I could not go to the banks anymore.”

The governor said that his administration remained pro-workers in spite of the tight corner it had found itself, pledging to pay the salary arrears as soon as the means was available.

He reiterated the commitment of his administration to the welfare of the people, adding that he had demonstrated the commitment with the implementation of a number of programmes.

UN Secretary-General Ban Ki-moon on Wednesday warned that the practice of forced bondage continued to resound around the world.

He said the bondage continued from forced labour and trafficking to sexual exploitation and captivity inslavery-like conditions.un

Ki-moon said this in a message marking the `International Day of Remembrance of the Victims of Slavery and the Trans-Atlantic Slave Trade’ in New York.

“Tragically, slavery has still not ended; slavery stubbornly persists in many parts of the world.

“I call for a renewal of our commitment to end modern slavery, so our children will live in a world free of racism and prejudice with equal opportunity and rights for all.

“Meanwhile, these despicable practices could not exist without deep-seated racism.

“It is absolutely vital that the dangers inherent in racism are made crystal clear to all,’’ Ki-moon stressed.

He also acknowledged that women slaves had played a key role in maintaining the dignity of their communities, adding that, too often, their leadership and brave resistance have been underestimated or forgotten.

The UN chief said that the Trans-Atlantic slave trade remained a monstrous crime and a stain on human history.

“On this important Day of Remembrance, I call for a renewal of our commitment to end modern slavery.

“So our children will live in a world free of racism and prejudice with equal opportunity and rights for all,’’ he said.

The UN secretary-general also unveiled the `Ark of Return,’ a permanent memorial honouring slaves, which he said would “bring home to people from around the world the terrible legacy of the slave trade.’’

On 25 March every year since 2007, the UN observes the International Day to honour the over 15 million men, women and children who suffered and died during the over 400-year Trans-Atlantic slave trade.

This year’s theme: “Women and Slavery,” paid tribute to and celebrates the strength of the many enslaved women who endured unbearable hardships, including sexual exploitation.

It also paid tribute to those who fought for freedom from slavery and advocated for its abolition.

According to the UN, it is estimated that one third of the approximately 15 million people who were deported from Africa through the Trans-Atlantic Slave Trade were women.

Court Orders INEC To Conclude Oguta Assembly Poll

A Federal High Court in Owerri on Wednesday ordered the Independent National Electoral Commission (INEC) to conclude the Oguta State Constituency election.

The judge, Justice S.M. Shaibu, in his judgment, rejected the reliefs sought by Chief Eugene Dibiagwu that INEC should declare him the winner of June 29, 2013 re-run election.

Shaibu held that granting the plaintiff’s reliefs would “amount to shifting  the goal post at the middle of a football competition.INEC

“Also, this will look like a relay race, athletes lined up to run and a whistle is blow and you discovered that one of the athletes did not observe the rule and you decide to call them back, you do not disqualify anybody at that stage.’’

He held that INEC did not declare anybody winner or issued certificate of return to any after the re-run, noting that it would be wrong for the court to do so.

The judge, however, urged the commission to complete what was left of its job in the constituency.

Dibiagwu of the Peoples’ Democratic Party (PDP) had urged the court to declare him as the winner of the poll.

He urged the court to reject Chief Walter Uzonwanne as the candidate of All Progressives Grand Alliance (APGA) in the re-run poll.

FG Inaugurates Dualisation of Sapele-Ewu Road

Electoral Act Amendment Bill Yet to be Signed by Buhari - Presidency Officials

The Minister of Works, Mr Mike Onolememen, on Wednesday inaugurated the dualisation of the 185.7-kilometre Sapele-Ewu road in Delta and Edo respectively.

The News Agency of Nigeria (NAN) reports that the project was divided into two sections to be handled by different contractors.

Section one covers Sapele-Agbor in Delta while section two covers Agbor-Ewu in Edo at a total cost N112.8 billion.

The minister performed the flag off for the section one in Sapele, Delta and later performed that of section two at Igueben in Edo.

He said the 110.6-kilometre Sapele-Agbor road single carriageway would be dualised at the cost of N64.8 billion adding that the work would be completed in 30 months.

Onolememen added that the section two, which covered 75.1 kilometres from Agbor in Delta to Ewu in Edo, would be executed at a total cost of N47.9 billion and would be completed within 36 months.

The minister said that the contract for section one was awarded to CGC Nigeria Limited while section two was awarded to Setraco Nigeria limited since Dec. 2014.

According to him, the Sapele-Agbor road connects the South-South and the South-East geopolitical zones of the country.

“The project commences from Amukpe near Sapele and traverses Abraka, Obiaruku to terminate at the Benin-Asaba Expressway in Agbor in Delta.

“Complete dualisation of this road will reduce current traveling time, cost of vehicle maintenance and increase socio-economic activities of the communities along the alignment and other roads.”

He called on the State Government and all the communities to give the contractors maximum support to enable them to deliver on promises.

He also urged the people of the area to support President Goodluck Jonathan’s second term bid, to enable him to deliver these projects and many others.

Gov. Emmanuel Uduaghan of Delta said the inauguration demonstrated how sensitive Mr President was to the yearlings and aspirations of Nigerians.

The governor, represented by Commissioner for Special Duties, Mr Austine Ayemidajor, said Peoples Democratic Party had built infrastructure and invested in health, education, agriculture, among others.

He, therefore, urged Nigerians to reciprocate Jonathan’s dedication to the cause of developing the country by voting for him for a second term in office.

He appealed to the minister to assist the people of Sapele by building a network of flyover at the Amukpe roundabout in order to reduce vehicular accidents.

The governor assured that the project would be protected and supported to ensure that the contractors delivered the work without hitches.

DSS Tutors Voters On Security Measures on Election Day

The Department of State Services (DSS) has advised voters in Saturday’s election to be weary of persons who dress in loose or bulky midriff clothing’’.

This advice is contained in a statement signed by Marilyn Ogar, DSS  spokesperson, in Abuja on Wednesday.

The statement maintained that those dresses were inappropriate for the current weather.

It also advised them to look out for unattended bags, luggage, dustbins, strange containers and other suspicious items.

“Equally, they should remain vigilant in crowded environments before, during and after the elections and abide by all stipulated guidelines emplaced to ensure peaceful conduct.

“Similarly, all vehicles, motorcycles, tricycles and bicycles must be parked far away from the polling stations.

“All forms of trading should be discouraged, suspicious persons, activities and movements should be promptly reported to security agents,’’ it stated.

“Once again, we restate our commitment to ensuring a peaceful atmosphere for all Nigerians to contribute toward strengthening our democracy,’’ the statement stated.

Fani-Kayode Alleges Compromise of INEC Card Reader Master key

The Peoples’ Democratic Party (PDP) has alleged that the Master key (encryption/decryption) of the Independent National Electoral Commission (INEC) Smart Card Readers may have been compromised by the opposition.

Mr Femi Fani-Kayode, Director of ‎Media and Publicity of the PDP Presidential Campaign Organisation, made the allegation at a news conference in Abuja on Wednesday.

Fani-Kayode alleged that the company that supplied the card readers for the general elections had links with the opposition.new INEC Card

According to him, a major shareholder and board member of the company, Act Technologies Ltd., is an ardent supporter of the APC.

“The master encryption/decryption Key can unlock and simulate the Permanent Voter Cards (PVCs) data processed by the smart card reader.

He said there was only one copy of the master key in the country, which he said, was in the possession of an individual and a known APC sympathiser and supporter.

This same individual, he said, was also the contractor responsible for the production of the PVCs and the supply of card reader to INEC.

“The master key should rightly be in the possession of INEC as the neutral umpire, under the most stringent access control protocol and not freely in the possession of a partisan actor,’’ he said.

He wondered why INEC would contract the supply of the card reader to an APC supporter, noting that “this constitutes a serious breach of security.

“This has grave implications for the PDP as the opposition APC armed with the master key and sufficient VINs can actually simulate the same data transmitted from any smart card reader deployed for the elections at will.

The situation is even now worsened by the fact that APC no longer has to purchase VINs or PVCs as they can now download the entire VINs directly from the INEC database.

He stressed that the development if not handled properly and looked into was serious enough to affect the outcome of the coming presidential election in a negative way.

Fani-Kayode, however, said that the organisation and the PDP candidate, President Goodluck Jonathan, were not in any way worried about what the outcome of election would be.

He said that PDP had the backing and support of Nigerians, adding that “it will not only win the elections but will win convincingly.

“Whatever we share with you here today does not in any way mean that we shall not participate in Saturday’s election or that we are worried about how we will fare.

“The fact of the matter is that we shall not only participate but we are also very confident of winning.’’

He further expressed the hope that Nigerians would give Jonathan a fresh mandate for the next four years regardless of the antics of the opposition and those covertly working for them.

Fani-Kayode said the essence of sharing the information was to alert Nigerians and security agencies of what was going on and to ensure that INEC did the right thing.

He said that it was critical for INEC to answer questions raised on the issues and put its house in order so that the outcome of the election was not in any way questionable.

The campaign organisation spokesman enjoined PDP supporters and polling agents to be vigilant, guard and protect their votes.

He advised them to stay at the polling booths after voting to ensure that their votes were counted and not manipulated or changed.

Jonathan Says Gwoza To Be Liberated Friday

President Goodluck Jonathan on Wednesday in Abuja assured that Gwoza in Borno, the last town under Boko Haram terrorists, would be liberated by Friday to pave way successful conduct of general elections in all states of the federation.
Jonathan, who gave this assurance when he received four International Election Monitoring Groups, said already the Nigeria soldiers had successfully liberated Adamawa and Yobe from the menace of insurgency.

According to him, the military command has also assured him that Gwoza will not only be recaptured, but Sambisa forest in Borno will be Boko Haram-free in the next weeks.
He said already soldiers had intensified efforts to drive away the terrorists from the forest.
“But we cleaned up Adamawa completely, we cleaned up Yobe completely and even Borno state, before the election, election is two days away.

But, before the elections you will see that only one little area, the Sambisa forest in Borno state only will be in the hands of Boko Haram because we believe by tomorrow latest Friday, we will be able to take over Gwoza the last town under Boko Haram terrorists.If we take over Gwoza it will not take us more than one week to clean up the whole remaining part.

For now they are not in the position to come out and disrupt elections.We are very hopeful that when we conduct elections on March 28, elections will be conducted across the country.’’
The president reassured that the coming elections would not generate the type of violence that followed the 2011 elections.

He said, “first and foremost let me reassure the international community and indeed Nigerians that elections will be conducted as rescheduled by INEC. On Saturday we will have the presidential elections and National Assembly elections and then the April 11 of next month we will have the governorship and state assembly’s elections.
He, therefore, pledged to ensure the conduct of free, fair and credible elections under peaceful atmosphere.

In their remarks, the international observers stressed the need for free, fair and peaceful conduct of the March 28 and April 11 general elections.

Justice Ademola Adeniyi of the Federal High Court sitting in Abuja, yesterday, adjourned 10 separate suits that are seeking to disqualify the Presidential candidate of the All Progressives Congress, APC, Mohammadu Buhari, from participating in the March 28 presidential election, for hearing today.

In a ruling yesterday, Justice Adeniyi said he would hear the substantive suits and all the reliminary objections that were raised against them by both Buhari and the APC together.

All the pending applications were consolidated for hearing on a day two human right activists, Mr. Chukwuma Ochu who is a member of the APC in Rivers State, and Mr. Ebun-Olu Adegboruwa from Lagos state, applied to be joined as interested parties in the matter.

The court noted that since all the suits were basically anchored on the same subject matter, which is the eligibility or otherwise of Buhari to contest in the forthcoming presidential election having allegedly supplied false information to the Independent National Electoral Commission, INEC, with regards to his educational qualifications, it would be better to slate all of the matters for hearing on the same day.

Justice Adeniyi stressed that whatever judgment that is entered on the very first suit which was lodged before the court by Mr. Chukwunweike Okafor, would impact on all the other cases pending against the APC presidential candidate.

Specifically, ‎the plaintiffs are among other things, praying the court ‎for a declaration that the 1st defendant, Buhari, is not eligible to participate in the 2015 presidential election for failure to comply with the terms for submission of list of candidate and affidavit of personal particulars of persons seeking election to the office of President.

They are seeking similar reliefs, including, “A declaration that by the combined provisions of sections 31(1) (2) and (3) of the 2010 Electoral Act (as amended) and INEC Form CF 001, the 1st defendant is mandatorily obliged by law to comply strictly with the provisions laid down under the Electoral Act (as amended) and INEC Form CF 001 as it relates to attaching evidence of the 1st defendant’s birth certificate and evidence of his educational qualifications as required under INEC Form C.F 001.

“A declaration that the Curriculum Vitae and Voters Registration card attached by the 1st defendant in his INEC ‎Form C.F 001 and submitted to the 2nd defendant, INEC, as a Presidential Candidate in 2015 general election is not in conformity with the form prescribed by the Electoral Act/INEC Form C.F. 001 and is manifestly in contravention of the said Act/INEC Form C.F. 001 and therefore null and void”.

One of them, Mr. Max Ozoaka, is particularly seeking for an order of court declaring as invalid the INEC Form C.F. 001 as filled and submitted by Buhari “as being inchoate and manifestly in contravention of the provisions of the Electoral Act”.

He argued that Buhari’s failure/ refusal to attach evidence of his birth certificate and educational qualifications, “which are conditions inherent/ precedent ‎as prescribed in the form”, was in breach of relevant laws in Nigeria pertaining to presidential election.

He prayed the court not to only declare the Form CF. 001 that was submitted to INEC by Buhari ‎for the 2015 presidential election as incompetent, but to also declare that the Voters Card that was attached to the form was false on the ground that as at when the voters card was issued, the 1st defendant was not a “public servant” as he allegedly stated.

“An order ‎declaring the said voters card as void for containing false information about the identity/occupation of the 1st defendant.
“An order disqualifying the 1st defendant from contesting and/or participating in the Presidential election fixed for February 14, 2015 or any date that the 2nd defendant may fix on the ground that the information contained in the 1stbdefendant’s INEC Form CF. 001 is false.

“An order restraining the 2nd defendant from permitting the 1st defendant from participating in the Presidential election fixed for February 14, 2015 or any other date that the 2nd defendant may fix”.
Ozoaka posed eight questions for the determination of the court, among which included; “Whether having regards to the provision of section 31(8) of the Electoral Act, as amended, and INEC Form C.F. 001 filed by the 1st defendant and the fact that the 1st defendant stated therein that he is a member of the All Progressives Congress Party (APCP), whether the 1st defendant is a member of a political party recognised by law in Nigeria which will enable him to participate in the 2015 presidential election.

“Whether or not the identification/voters card submitted by the 1st defendant to the 2nd defendant wherein the 1st defendant is shown to be a “public servant” as at January 22, 2011, is true or false?

“Whether or not the document purported to be the Statement of Result/Result Sheet of the 1st defendant’s Secondary School Certificate Examination (SSCE) provided by the Government College Katsina and the Katsina State Ministry of Education and referred to at the Press Conference of the 1st defendant held on January 21, 2015, is truly and correctly that of the 1st defendant, having regard to the name of the 1st defendant as stated in his affidavit submitted to the 2nd defendant and the name in the said document”.

‎In a 30 paragraphed affidavit that was deposed to by the plaintiff, he averred that the 1st defendant retired from Nigerian Army on August 1985 after he was removed from office as military Head of State pursuant to a military coup.
“That the 1st defendant left the Petroleum (Special) Trust Fund as its Executive Chairman in May 1999. That I know for a fact that th‎e 1st defendant stated on oath that his certificates evidencing his educational qualifications are in the possession of the Nigerian Army.
“That I know for a fact that at a press conference held on January 20, 2015, the Nigerian ‎Army spokesman, Brigadier General Oluseye Lajide stated that the Nigerian Army is not in possession of the 1st defendant’s certificates evidencing his educational qualifications”.

He told the court that a Statement of Result that was eventually made available to the press by the 1st defendant through ‎Government College Katsina and a University of Cambridge West Africa School Certificate Result sheet, had the name of one “Mohammed Buhari”, “and not the name of the 1st defendant as copi‎ously appeared and used in the 1st defendant’s voters card. Affidavit and other documents attached to his INEC Form C.F. 001”.

Meantime, both Buhari and the APC have queried the competence of all the suits, even as they challenged the jurisdiction of the court to hear them.
The defendants equally challenged the propriety of orders of Justice Adeniyi which had permitted the plaintiffs to serve the Originating Summons on them through substituted means.

Justice Adeniyi had on February 2, directed that the court processes should be served on the defendants by publishing same in three national dailies.
The court also granted an order of abridgment of time within which the defendants must respond to the suits.
‎However, both Buhari and his party, contended that there was no urgency in the matter to warrant the court to hear the suits in a hurry.

Thus, in separate preliminary objections that were filed by counsel to Buhari, Chief Wole Olanipekun, SAN, and that of the APC, Prince Lateef Fagbemi, SAN, they asked the court to set-aside all the orders it has made in the matter so far.
It was further their contention that the subject matter of the suit bothers on pre-election issues which they said is not time bound, adding that the suits could be determined even after the presidential election.

Nevertheless, counsel to the plaintiff, Chief Mike Ozehkome, SAN, urged the court to expedite hearing on the matter so as to determine Buhari’s fate before the presidential poll.
Ozehkome relied on Order 29 Rules (1- 5) of the Federal High Court Civil Procedure Rules, and insisted that there was need to speed up hearing on the matter.

“Our application has to do with the disqualification of the 1st defendant. It is better to do it timeously before the election. My lord there are more than 16 presidential candidates participating in the election. Does it mean that disqualifying one of them will amount to truncating the election? That is over exaggeration my lord

“The position of the law as adumbrated in a legion of cases, starting from the apex court, is that in an action commenced by Originating Summons such as ours, which is meant ‎to construct certain section of the Electoral Act and the constitution, the Originating Summons should be taken together and cumulatively with any process challenging the jurisdiction of this court to hear the suit.

‎”This matter should be expeditiously heard and determined before March 28 so that we don’t have the situation of having a pretender put on the throne”, Ozehkome posited.
His submission infuriated Buhari’s lead counsel, Olanipekun, SAN, who insisted that all the suits were targeted at stopping the presidential election.

Olanipekun urged the court not to allow itself to be ‎used as a tool to truncate democracy in Nigeria, stressing that “section 87(11) of the Electoral Act, as amended, cautions courts not to do anything or take any action or issue any injunction that will stop the holding of primary or general election”.

He said: “My lord, it appears that this matter ‎is targeted at stopping the presidential election, if that is the case my lord. This court should not be used for that purpose.
‎”There is no law, authority or decision that compels any court to give judgment in a pre-election matter before the election itself. The matter is not time bound; it is not like election petition.

“My lord the Supreme Court has held that pre-election matter remains a live issue before or after election. What we are saying is that the court is not encouraged to rush pre-election matters because it is said that justice rushed is justice crushed”, he argued.
On its part, the APC, through its lawyer, Prince Lateef Fagbemi, SAN, aligned with Buhari and argued that the issue about the legality of the service of the court process on the defendants ‎must be determined first.
Likewise, INEC lawyer Mr. Hassan Liman, SAN, told the court that the commission has also entered a preliminary objection against the suits.

Presidential Election: Survey Gives Jonathan 17% Edge over Buhari

A survey conducted by two independent research firms has projected that President Goodluck Jonathan of the Peoples Democratic Party (PDP) would defeat All Progressives Congress (APC) presidential candidate, General Muhammadu Buhari, in next Saturday’s presidential elections with at least a margin of 17%.

The survey was carried out by Chike Uchime of FORWARD MAGAZINE and Daniel Dickson-Okezie of Zevland Ventures Limited
According to the report of the survey, contrary to earlier projections that General Buhari’s party (the APC) would capture, wholesale, the votes of the South West geo-political zone, the reality on ground today, as revealed by an independent survey, is that President Jonathan has unlocked the pathway to even out votes in that region.

Using 24,000 sample size across 33 states and the FCT, to decide through an Opinion Survey who will win the presidential election, the outcome of the research exercise was based on three critical factors: (1) The respondents’ views on the achievements or performance of the President from 2011 to date and to see how this can affect his chances in the coming election; (2) The correlation between the outcome of the 2011 Presidential Election and the likely outcome of the 2015 Presidential Election; (3) A detailed study of the various dynamics that have taken place since 2011 and the likely impact on the outcome of the 2015 Presidential Election.

According to the survey, “When asked which of the two main political parties they preferred, 65 percent of the respondents opted for PDP, while 31 percent favoured the APC.
The survey report highlighted the dynamics that have taken place since the 2011 election.

CONFAB: Jonathan Re-assures South-East of Additional State

President Goodluck Jonathan in Owerri, Imo State, South East Nigeria says he is committed to the implementation of the recommendation of the just concluded National Conference  on state creation.

Jonathan who gave the assurance on Tuesday during a reception by the Imo State Council of Traditional Rulers in Owerri , Imo state capital assured that the South East zone would get an additional state to bring them at par with other zones in the country.

He noted that the South East geo-political zone with only five states would get additional one as recommended by the National Conference for equality before any other zone agitating for additional state is considered.south east new

He urged the people to translate the massive support they have shown to his administration to large votes on Saturday during the presidential and national assembly elections to enable him consolidate on the achievement of his administration.

President Jonathan said he was elated for the massive support he had received from the zone, adding that he was sure that the same support would be given to him and his party in the general elections to enable him consolidate on the achievements of his administration so far.

“The South East is the support base of the PDP and I am here again to solicit for your supports and blessing in the Saturday election.

“The South East has not supported anybody the way they have supported me since 2011 and in the next four years, I will ensure that the zone benefit more in terms of projects and most importantly, I will also ensure that the recommendation of the National Conference which has been adopted by the Federal Executive Council (FEC), is religiously implemented.”

The Chairman of  Imo State Council of Traditional Rulers and Chairman, South East Council of Traditional Rulers, Eze Cletus Ilomunanya appealed to the president to come and rescue the royal fathers in the state as they have suffered so much deprivation in the hand of those who do not understand  how the traditional institution operates.

The royal fathers said that they are solidly behind the re-election of President Jonathan, because he has   done marvelously well in the last four years.

CBN Gives Banks Three Months To Submit Recapitalization Plan

The Central Bank of Nigeria, CBN has directed some systemically important banks considered too big to fail, that are short of capital to submit recapitalization plans to it by June 13th.

The CBN letter suggest that a few undisclosed banks do not meet the minimum CAR of 10 per cent and 15 per cent for regional/national and international banks, respectively, under Basel II. These banks have been given three months, till 13 June 2015, to submit recapitalisation plans and till 30 June 2016 to implement same.

The letter also affirms CBN’s willingness to support the banks in their bid to raise the required capital.The Central Bank

Some banks have either been raising funds through rights issues or have approached the international capital market to raise dollar denominated bonds.

CBN last year classified eight Nigerian banks – First Bank of Nigeria Limited (FirstBank), Zenith Bank Plc, Guaranty Trust Bank Plc (GTBank), United Bank for Africa Plc (UBA), Access Bank, Ecobank Nigeria Plc, Diamond Bank Plc and Skye Bank Plc – as systemically important financial institutions (SIFIs) and imposed on them a new set of rules, requiring them to maintain a minimum Capital Adequacy Ratio CAR of 16 per cent.

Renaissance Capital in its note to investors said “On 13 March, the Central Bank of Nigeria (CBN) issued a letter to the banks, extending the implementation deadline for higher capital requirements for systemically important banks (SIBs).

It set a deadline for banks that breach minimum capital adequacy ratios (CAR) under Basel II to submit their recapitalisation plans and execute same”.

It said “One of our key takeaways from the CBN is that a few banks (undisclosed) do not meet the minimum CAR of 10 per cent and 15 per cent for regional/national and international banks, respectively, under Basel II. These banks have been given three months, till 13 June 2015, to submit recapitalisation plans and till 30 June 2016 to implement same”.

The letter also affirms the Central Bank’s willingness to support any under-capitalised bank and that it may require rapid remedial actions if adequate capitalisation is not restored. “In our view, this extension is a positive development for Nigerian banks as we have previously noted that the pace of implementation of Basel 2 (nine months) and other tighter capital requirements were rather speedy”.

“That said, feed back from our recent international investor road show suggests that given the deteriorating Nigerian macro environment, significant capital-raising events could struggle to attract meaningful international investor participation. We also find international investors increasingly questioning the Nigerian banks’ ability to create value given constraining regulations and weakening macro fundamentals.

”We, however, think that the domestic investor pool or private equity capital could be supportive in some dire instances, drawn by depressed valuations and/or the long-term investment case for the sector.”

“In addition to the above, the implementation of the 1 per cent all-tier 1 capital buffer for SIBs, which raises their minimum total CAR to 16 per cent, has been extended to 1 July 2016, from 1 March 2015. Essentially, while the banks may today or indeed over the next 15 months comply with a 15 per cent minimum CAR, we think the banks need to give serious consideration near term to meeting a 16 per cent minimum CAR requirement and establishing a buffer to support future growth”.

Civil Servant Charged With Rape of A 15-year-old Girl

Lagos – A 34-year-old civil servant, Segun Oluyara, on Tuesday appeared before a Yaba Chief Magistrates’ Court in Lagos over alleged rape of a 15-year-old girl.

Oluyara, who resides at No. 36, Oduntan St., Ketu, Lagos, is facing a charge of unlawful sexual intercourse.

The prosecutor, ASP Godwin Anyanwu told the court that the accused committed the offence (rape) on March 18 at about 2.00 p.m. at No.114, Ogunmefun St., off Pedro,Lagos.the accused, civil servant

He said, the civil servant and the victim met at a restaurant and promised her job.

“The accused took the victim to a guest house and claimed to be the owner.

“The accused took the victim to a room and pushed her on the bed before he forcefully had unlawful sexual intercourse with her.

“The accused gave the victim a soft drink and a drug ‘postinor 2′ to prevent pregnancy.

“The girl told her mother, who reported the case to the police and the accused was arrested,’’ he said.

“The victim was taken to the hospital for medical checkup and treatment.”

Anyanwu noted that the offence contravened Section 137 of the Criminal Law of Lagos State, 2011.

The accused may be sentenced to life imprisonment on conviction.

The accused, however, pleaded not guilty to the charge.

The Chief Magistrate, Mrs A.O. Soladoye, granted the accused bail in the sum of N200,000 with two sureties in like sum.

She said the sureties must show evidence of three years tax payment to the Lagos State Government as part of the bail conditions.

She adjourned the case to May 4 for advice from the State Director of Public Prosecutions.(NAN)

An account given by Asim Qureshi, Research Director of Cage, `a group that campaigns for those detained on terrorism charges’’ said he was born in Kuwait, Emwazi came to Britain aged 6.

He graduated with a computer programming degree from the University of Westminster before coming to the attention of Britain’s main domestic intelligence service, MI5.
Qureshi told a news conference in London, that Emwazi, a fluent Arabic speaker, said MI5 had tried to recruit him.

He had also claimed that the security organisation then prevented him from travelling abroad, forcing him to leave the country without telling his family.

The Resident Electoral Commissioner (REC) in Anambra, Mr Edwin Nwatarali, said 1,000 card readers had been reserved to respond to cases of failure of the card in the forthcoming general elections in the state.

Nwatarali, who made this known in an interview with the News Agency of Nigeria (NAN) in Awka on Friday, said that the earmarked cards were part of 5,132 card readers delivered to the Independent National Electoral Commission (INEC) in the state.Resident Electoral Commissioner

He said that three card readers would be assigned to each of the 326 electoral wards kin the state, explaining that the 1,000 card readers would be kept to take care of emergencies and failures.

He said that INEC was making adequate preparations for the new dates of the elections and assured that the commission had enough capable hands for the exercise.

The REC disclosed that 22,000 ad hoc staff had been recruited and trained for the exercise in the state, adding that the ad hoc personnel would also be retrained two weeks before the elections ‘’to refresh their minds on the job expectations’’.

He said that the commission had had meetings with the Inter-Agency Consultative Committee representatives of security agencies in the state, stressing that reasonable security provision would be made for the polls.

Nwatarali said that the security agencies in the state had also assured that they were ready ‘’before, during and after elections to secure lives and property’’.

He said that the level of Permanent Voter Cards (PVCs) distribution in the state had improved, adding that out of 1,917,882 PVCs received, 1,355909 had been collected by the voters.

“We have distributed 82 per cent of PVCs received so far and we are still waiting 45,545 cards that are yet to be delivered to us.
“These undelivered PVCs are for people who complained of their transfer and have not got their cards,’’ he explained.

He urged the people who have not received their cards to visit the INEC offices in their local government areas to do so as only those with it would vote

The Nigerian National Petroleum Corporation (NNPC) on Friday said it had injected additional 688 million litres of petrol into the market to address the noticeable fuel queues in some cities across the country.

This is contained in a statement by Mr Ohi Alegbe, Group General Manager, Group Public Affairs Division of the corporation, in Abuja.

Alegbe, however, explained that what appeared to be scarcity of petrol was artificially.
He said the corporation had already increased the volume of petroleum products being supplied to marketers substantially.

“The NNPC is injecting an additional 600,103.05 metric tonnes of premium motor spirit, the equivalent of 688 million litres of petrol into the market within the next 48 hours.

“This is to arrest any short fall that may have been triggered by the unnecessary fears of an imminent scarcity of products,” he said.

He, therefore, called on members of the public not to engage in panic buying and hoarding of petroleum products, saying that NNPC was working with all downstream stakeholders to eliminate the artificially-induced queues in some fuel stations.

Meanwhile, the Department of Petroleum Resources (DPR) told the News Agency of Nigeria (NAN) that the noticeable scarcity was caused by a ‘’slight drop in the lifting of fuel from the depot earlier in the week’’.

Spokesman of Abuja Zonal office of DPR, Mr Seidu Mohammed, however, said the situation had been checked with the injection of more petrol into the market.
Mohammed said that the scarcity was artificial and the situation would be normalised before the weekend because marketers had started lifting more product.

Mr Farouk Ahmed, Executive Secretary of Petroleum Products Pricing and Regulatory Agency (PPPRA), had in a statement earlier, warned marketers against hoarding or adjusting their pump price above official price of N87 per litre of petrol.
He said PPPRA, in collaboration with the DPR, would ensure that marketers did not cheat on consumers.

“In other words, any violation of the warning will attract appropriate sanctions,” he said.
Farouk also advised Nigerians against any form of panic-buying, stressing that there were enough products in all depots across the country.

He assured Nigerians that the PPPRA, in exercise of its mandate, was fully committed to ensuring adequate supply and distribution of petroleum products around the country.
The News Agency of Nigeria (NAN) reports that queues were noticeable in Abuja metropolis, especially as filling stations in satellite towns in the Federal Capital Territory refused to sell the product.

At the Total and Conoil petrol stations opposite NNPC headquarters, the long queues of vehicles led to heavy traffic problem.
Other filling stations in the city, including NNPC Mega and Conoil, on Olusegun Obasanjo Way were also besieged by motorists in search of petrol. (
