The Yaba Magistrate Court on Tuesday granted bail to #EndSARS promoter, Peter Eromosele after spending 10 days in police custody.

Eromosele, was granted bail in the sum of N1 million with two sureties who must be family members.

He was arrested for participating in the #EndSARS protests in October which were later hijacked by hoodlums in Lagos.

The police counsel had argued in court that Eromosele’s fundamental right can be temporarily tampered with to forestall order, saying that protest organisers should be prosecuted in case peaceful protests become chaotic.

The police prosecutor asked for a remand order to enable the police keep him in custody while he is being investigated for alleged criminal conducts.

However, Eromosele’s counsel described the application filed by the police as “a threat to his fundamental rights”, adding, “All weapons fashioned against him shall fail”.

The counsel argued that the police have had enough time to investigate the case since he has spent 10 days in custody already.

He said his freedom should not depend on the ability of the Police to speedily investigate the case against him.

Countering the demands, Eromosele’s counsel said he has the constitutional right to call for a protest, noting he has not violated any law.

“They (Police) are trying to overreach not only the defendant, but the court of law,” he said.

“The court should not allow itself to be used to cover incompetence.”

The magistrate granted the request, saying it was important to uphold the fundamental rights of Eromosele.
