The Economic and Financial Crimes Commission, EFCC Gombe Zonal office has secured the conviction of one Mahmud Mo’Allahyidi before Justice Nathan Musa of Adamawa state High Court who was arraigned on two count charge bordering on Criminal Breach of Trust and Cheating.
The convict was arrested by the EFCC Operatives following a petition by one Ghazali Mai-shanu Ali, who alledged that sometimes around April, 2017, Ghazali was travelling to Yola, Adamawa state to buy guinea-corn, on his way, he met the convict in a commercial transport and began to discuss. The convict successfully convinced and lured him to buy the goods at a cheaper rate in a place unknown to him.
The goods were bought and loaded in a truck to Kano, unfortunately for Ghazali, he had emergency issues and left the goods with the convict on trust in other for him to assist and send it to Kano.
He was asked to settle the transportation fare which he obliged. But to his greatest surprised, the convict cut off all communication with him and all effort to reach him to recover the goods proved abortive.
When the charge was read to him today, he pleaded guilty immediately. The prosecution counsel S.M Aliyu then applied under Section 157 of the CPC that the accuse person be tried summarily and also applied for the review of the facts of the case.
Justice Nathan convicted and sentenced him to three years imprisonment or N50,000 option of fine for count one (criminal breach of trust) while for the count two (cheating) was sentenced to one year imprisonment or N30 , 000 option of fine.
However, restitution order was given for the convict to pay the complainant the amount involved in the fraud. The payment is to be made through EFCC Gombe Zonal office.
