Against the backdrop of being an impacted party in the recent Federal High Court I judgment sitting in Asaba, Delta State that declared the Prophet Jones Erue’s faction of the State executive of the APC a nullity, Senator Omo-Agege who won the Delta Central Senatorial seat as a candidate that emerged from the Jones Erue’s faction has appealed the judgment.

It would be recalled that the Federal High Court 1, Asaba, in its March 18, 2019, judgement delivered by Justice Toyin Adegoke sacked the Prophet Jones Erue-led factional State Executive Committee, but upheld the Chief Cyril Ogodo-led exco faction as the authentic party’s State Executive Committee.

Although the court did not make any consequential order as to the positions of the party’s candidates that won their elections in the national and House of Assembly elections, the court however by the judgment, nullified all actions so far taken by the Prophet Erue’s exco faction.

After denying being affected by the Federal High Court judgment, maintaining that his candidacy was the product of a consent judgment, Senator Omo-Agege has however approached the Court of Appeal to seek the leave of the court to appeal the judgement.

Also in court to seek leave of court to appeal is Rev Francis Waive who was declared winner of the Delta Ughelli north, south and Udu house of representative seat.

Omo-Agege and Waive had, through their counsel Barr. Alex Iziyon, SAN, while seeking the leave of the court to appeal the judgement, filed an exparte motion which was granted to them to enable them serve Chief Cyril Ogodo by pasting service at the state party secretariat in Asaba.
