The anti-Buni APC in Delta State has again kissed the dust as they lost yesterday in a suit which was struck out by an Asaba High Court in Delta State.

The case with Suit No. A/139/ 2021, Between: Chukwusa Edafe Matthew & 14 Ors Vs. APC & Ors which was filed to set aside APC Ward, LGA and State Congresses that held a few months ago in the State, was struck out yesterday by Hon. Justice G.B. Briiki-Okolosi of High Court 2, Asaba.

About two months ago, a similar suit filed by Elvis Ayomanor & Ors also seeking the nullification of the APC congresses that held across the state suffered the same fate when it was struck out by an Asaba High Court.

In a brief judgment delivered by the Presiding Judge, Justice G. B. Briki-Okolosi, he noted among others, that the claimants’ action was non-justiciable as it is an intra-party matter.

Justice Briki-Okolosi also held that the matter was incurably defective, having been commenced by means of Originating Summons instead of Writ of Summons, as the issues raised are manifestly contentious.

Commenting on the judgment, a chieftain of the party, Matthew Omonade Esq, said: “In a space of two (2) months, the detractors of APC and their co-travellers have just been floored at the Delta State High Court of Justice, Asaba Judicial Division for the second time.
“The court held that the action is non-justiciable and incurably incompetent. It was emphatically re-echoed that the substratum of the matter borders on the internal affairs of the Party.”

The New Diplomat source disclosed that the suit was filed by a group that allegedly enjoys massive support from the Minister of State for Labour and Employment, Festus Keyamo (SAN), Chief Great Ogboru and Hon Victor Ochei.
The group is challenging the legality and constitutionality of the Governor Mai Mala Buni-led Caretaker/Extra-Ordinary Convention Planning Committee, CECPC.

With the latest High Court judgment , the Omeni Sobotie-led state exco remains the authentic and legitimate APC powerhouse in the state.
