A Federal Capital Territory (FCT), High Court in Abuja on Friday vacated an initial interlocutory injunction barring the All Progressives Congress (APC) from holding its National convention.
The ruling party had scheduled its national convention for March 26, where it will elect leaders into key national offices of the party.
However, a huge doubt was placed on the national convention as several aggrieved party members had taken the party to court, seeking an order to bar the party from holding the national convention.
On November 18, 2021, Justice Bello Kawu of the FCT High Court granted an order restraining the APC from holding the national convention.
The plaintiff in the matter, Salisu Umoru, dragged APC, the Chairman Caretaker Extraordinary Convention Planning Committee, Gov. Mai Mala Buni and the Independent National Electoral Commission (INEC) before the court to challenge the planned convention.
Meanwhile, Justice Kawu has vacated the interlocutory order made on November 18.
This was sequel to the argument of the defence counsel, Shuaibu Aruwa, SAN, praying the court to set aside its initial order.
Kawu vacated the order relying on the recent Supreme Court decision which held that a party member does not have the right to take the party to court.
The judge in his ruling held that the order of November 18, 2021, has been overtaken by a recent Supreme Court judgement on a similar matter.
