The Court of Appeal, Abuja Division has invalidated the election of Senator Attai Aidoko who represents Kogi East senatorial district.

Justice Abdul Aboki annulled the election in a judgement delivered on Monday at the appellate court in the Federal Capital Territory.

He held that Senator Aidoko was not the rightfully elected candidate at National Assembly primary election of the Peoples Democratic Party (PDP) which held in 2014.

The court consequently ordered that the sum of one million naira be paid by Aidoko to Mr Isaac Alfa whom the court held to be the lawfully nominated candidate of the PDP.

Mr Alfa, a member of PDP, was declared the winner of the re-run primaries for the party, but the party substituted his name with that of Senator Aidoko who came second.

He then instituted a pre-election suit after which Justice Nnamdi Dimgba upheld his claims in April that his substitution was unlawful, following which Senator Aidoko headed for the Court of Appeal.

Since it’s a pre-election matter, it is not clear yet if Aidoko would take his case to the Supreme Court.
